Welcome to Markayzee Sports Photography ("Markayzee," "we," "us," or "our"). These Terms of Service govern your use of our website, access to online galleries, purchases of photography services and products, and downloads of digital images. By using our website or purchasing our services, you agree to these Terms.

1. Website Use

This website is provided for clients, families, coaches, organizations, and visitors to learn about our services, access photo galleries, and purchase photography products.

All photographs, graphics, logos, text, and other content are the exclusive property of Markayzee Sports Photography and are protected by United States copyright law. No content may be copied, reproduced, modified, or distributed without prior written permission.

2. Photography Services

Markayzee Sports Photography provides sports action photography, team and individual photo day photography, tournament coverage, digital image downloads, and professionally printed photo products.

By reserving photography coverage or purchasing products, you acknowledge that photography is both an artistic and documentary service, and that image selection, editing, and delivery remain at the Photographer's professional discretion.

3. Action Photography Coverage

Sports are fast-paced and unpredictable. While we make every reasonable effort to photograph every participating athlete, coverage of any individual athlete, play, or specific moment cannot be guaranteed.

The number of images captured for each athlete may vary based on factors including, but not limited to:

Playing time
Athlete position
Game flow
Field or venue access
Lighting conditions
Safety restrictions
Simultaneous game coverage
Injuries or athlete availability

Our goal is to capture each athlete's best moments whenever opportunities arise rather than guarantee a specific number of images.

4. Weather & Event Changes

Photography coverage is provided for games or sessions that are played.

If an event is canceled before photography begins, prepaid customers may receive either a refund or account credit, depending on the circumstances.

If only part of an event is completed, coverage applies only to the games or sessions that occurred. Partial cancellations do not automatically qualify for refunds.

Rescheduled events are subject to photographer availability.

5. Injuries & Sensitive Content

The health and privacy of athletes are important to us.

As a general practice, we do not publish or promote photographs depicting injuries, medical emergencies, or other sensitive situations. We reserve the right to remove or withhold any image that we believe is inappropriate for public viewing.

6. Galleries & Access

We offer both private and public online galleries.

Private galleries are password protected and intended for clients, their families, or their organization.

Public galleries may be accessible to all visitors and may require an email address before downloading images.

Please do not publicly distribute private gallery links or passwords. We reserve the right to modify or remove gallery access at any time.

Online galleries may remain available for a limited time. Clients are encouraged to download purchased digital files promptly, as archived galleries may not remain permanently accessible.

7. Digital Downloads & Image Usage

Unless otherwise stated, purchased digital images include a personal-use license.

Personal use includes:

Printing for personal display
Sharing with family and friends
Posting on personal social media accounts

Images may not be:

Sold
Licensed to third parties
Used in advertising or commercial publications
Used by businesses or sponsors
Significantly altered beyond normal cropping without written permission

8. Photo Editing

Every image is individually edited in our signature style.

Editing decisions—including color correction, cropping, exposure adjustments, and final image selection—are made at our professional discretion.

RAW or unedited image files are not available for purchase or download.

9. Orders, Payments & Refunds

Payment is due as stated during booking or checkout.

Because photography services, digital images, and custom print products are personalized and non-returnable, all sales are final.

Refunds or credits may be considered only if:

No photography services were provided, or
No deliverable images exist due solely to photographer error.

Requests based on image quantity, artistic style, athlete playing time, or game circumstances are not grounds for refunds.

10. Email Collection & Communications

You may be asked to provide your email address to access galleries, download images, or make purchases.

By doing so, you agree that we may:

Maintain records related to your downloads or purchases.
Send order confirmations and gallery notifications.
Occasionally send photography updates, promotions, or special offers.

We never sell your personal information to third parties. You may unsubscribe from marketing emails at any time.

11. Limitation of Liability

We take great care in photographing, editing, and delivering your images. However, we are not liable for circumstances beyond our reasonable control, including but not limited to:

Weather
Schedule changes
Venue restrictions
Equipment malfunction
Memory card or file corruption
Internet or hosting outages
Third-party service interruptions

In the unlikely event that liability exists, it shall be limited to the amount paid for the affected photography service or product.

12. Changes to These Terms

We may revise these Terms of Service periodically. Updated versions will be posted on this website with a revised effective date. Continued use of our website or services constitutes acceptance of the revised Terms.
